Terms of Use (ToU)

These Terms of Use (ToU) aim to define the terms of access and use of The Beautiful Walk website (hereinafter "the Site") and the service offered by FibreTigre SA (hereinafter "the Provider").

By accessing the Site and using the service, the User accepts these ToU without reservation.

The Site offers a service for creating and sending personalized stories, based on users' daily journeys. To benefit from the service, the User voluntarily transmits:

The distance traveled each day (in kilometers),

The travel time,

A username and their email address.

The stories are then written based on this information, then sent by email to the User.

The service is paid. The rate and payment terms are specified on the Site.

The service is accessible to any adult natural person with internet access and a valid means of payment.

The Provider reserves the right to suspend or refuse access to the service to any User in case of non-compliance with these ToU or abusive use, particularly in cases of cheating or exceeding the recreational framework, for example distances exceeding 30 kilometers per day for several consecutive days.

The texts, stories, visuals, logos, trademarks and other content present on the Site and sent to the User are the exclusive property of the Provider and are protected by French and international laws relating to intellectual property.

Any reproduction, representation, distribution or exploitation, total or partial, without prior written authorization, is prohibited. Certain exceptional elements are free of rights.

The User consents to the collection of data strictly necessary for the execution of the service (email, journey data).

This data is used only within the framework of the service offered and is neither transferred nor sold to third parties.

In accordance with the GDPR, the User has the right to access, rectify, object to and delete their data. They can exercise this right at the following address: [email protected]

Data is kept for the time necessary to execute the service, then deleted.

The Provider undertakes to provide a quality service and to protect Users' data. However, they cannot be held responsible for:

A temporary interruption of the service for maintenance or update,

A failure to receive the email in case of a problem related to the User's access provider,

Any indirect damage related to the use of the service.

The service being personalized and executed immediately after receiving the data, the User expressly waives their right of withdrawal, in accordance with Article L221-28 of the Consumer Code.

Payment terms (rate, possible subscription, payment platform) are detailed on the Site.

The Provider reserves the right to modify these ToU at any time. The applicable version is the one in force at the time of using the service.

These ToU are subject to French law.

In case of dispute, an attempt at amicable resolution will be favored. Failing that, the competent courts will be those of the jurisdiction of the Provider's registered office.
